1. Definitions
In these Terms and Conditions, the following definitions apply:
"The Company" / "FPK" means FPK Car Hire Ltd, registered in England and Wales, Company Registration Number 15072283.
"The Hirer" means the individual who has entered into a hire agreement with the Company and whose name appears on the hire agreement.
"The Vehicle" means the private hire vehicle made available by the Company under the hire agreement, including all accessories, documents and keys.
"Hire Period" means the duration for which the Vehicle is hired, commencing on the date of collection and on a minimum hire period of one (1) calendar month, with the Hire Fee payable weekly throughout. After the initial month, the hire continues on a rolling basis until terminated in accordance with these Terms.
"Hire Fee" means the weekly charge payable by the Hirer for use of the Vehicle, as agreed at the commencement of hire.
"Damage" means any physical damage to the Vehicle beyond fair wear and tear, including bodywork damage, interior damage, glass damage, tyre damage caused by misuse, and any mechanical damage arising from negligence or misuse by the Hirer.
"H&R Insurance" means hire-and-reward motor insurance enabling the Hirer to legally carry fare-paying passengers in the Vehicle.
2. Eligibility Requirements
To hire a vehicle from FPK Car Hire Ltd, the Hirer must, at all times during the Hire Period:
- Hold a valid TfL Private Hire Vehicle (PHV) driver licence issued by Transport for London;
- Hold a valid DVLA driving licence with no more than six (6) penalty points, unless otherwise agreed in writing by FPK;
- Have in place valid Hire and Reward (H&R) motor insurance covering the specific Vehicle for private hire use — this is not provided by FPK;
- Provide a valid proof of address dated within three (3) months of the hire commencement date;
- Be aged 21 years or older;
- Provide copies of all required documents to FPK prior to collecting the Vehicle.
It is the Hirer's sole responsibility to ensure all licences, permits and insurance remain valid and in force throughout the Hire Period. The Hirer must notify FPK immediately if any licence, permit or insurance is suspended, revoked or expires without renewal.
3. Insurance
3.1 FPK Car Hire Ltd does not provide motor insurance as part of the hire agreement. The Hirer must hold and maintain valid H&R insurance covering the Vehicle before the Vehicle is released.
3.2 Proof of valid H&R insurance must be provided to FPK before the Vehicle is made available to the Hirer. Failure to produce valid insurance will result in the Vehicle not being released.
3.3 The Hirer is responsible for notifying their insurance provider of all material facts relevant to their cover, including any changes in circumstances, accidents or incidents.
3.4 FPK accepts no liability for any losses, claims or damages arising from the Hirer's failure to maintain adequate insurance cover.
4. Hire Agreement & Payment
4.1 The minimum hire period is one (1) calendar month. The Hire Fee is payable weekly in advance throughout the Hire Period, on the same day each week as the commencement of hire. By way of example, a weekly rate of £140 represents a minimum financial commitment of approximately £560 for the first month. After the initial month, the hire continues on a rolling basis until either party gives notice to terminate.
4.2 A refundable security deposit is payable upon collection of the Vehicle. The deposit will be returned to the Hirer following the satisfactory return of the Vehicle, subject to any deductions for outstanding amounts, damage costs or unpaid fines attributable to the Hirer.
4.3 The Hire Fee is based on the vehicle model and registration year and starts from £140 per week. The specific weekly rate will be confirmed and agreed in writing at the commencement of hire.
4.4 FPK reserves the right to amend the Hire Fee upon providing the Hirer with reasonable written notice.
4.5 Failure to pay the Hire Fee when due may result in the hire agreement being suspended or terminated, and the Vehicle being recovered by FPK.
4.6 All amounts payable under these Terms are stated in pounds sterling (GBP).
5. Vehicle Maintenance & Servicing
5.1 FPK Car Hire Ltd is responsible for all routine servicing and scheduled maintenance of the Vehicle throughout the Hire Period. This includes routine oil changes, safety checks and MOT compliance.
5.2 FPK does not provide a dedicated breakdown or roadside recovery service. In the event of a breakdown, the Hirer must contact FPK as soon as possible. Where the Vehicle has broken down in close proximity to FPK, we will make reasonable efforts to assist, but this cannot be guaranteed. The Hirer is strongly encouraged to obtain their own breakdown cover through a recognised provider such as the AA, RAC or equivalent, prior to taking the Vehicle on hire. FPK accepts no liability for losses arising from a breakdown where recovery assistance cannot be provided.
5.3 The Hirer must check the Vehicle's oil level, coolant and tyre pressures on a regular basis and report any warning lights, unusual sounds or concerns to FPK promptly. Failure to do so, resulting in damage, may render the Hirer liable for repair costs.
5.4 The Hirer must not carry out, authorise or arrange any mechanical work, modifications or repairs to the Vehicle without the prior written consent of FPK.
5.5 All mechanical repairs will be carried out by FPK's trusted garage partner. FPK will make reasonable efforts to obtain the most competitive and cost-effective repair solution available.
5.6 FPK will arrange and pay for the Vehicle's MOT and PCO inspection when they fall due. The MOT will be booked no more than 13 days before the PCO test, in line with TfL requirements. FPK will notify the Hirer in advance of the scheduled date. On the day of the PCO inspection, the Hirer is required to leave the Vehicle with FPK for approximately two (2) hours while the inspection is carried out. If the Vehicle fails the PCO inspection, FPK will make reasonable efforts to provide the Hirer with an alternative available vehicle so they can continue working.
6. Damage to the Vehicle
6.1 The Hirer accepts the Vehicle in the condition noted on the hire agreement at the time of collection. The Hirer is responsible for returning the Vehicle in the same condition, subject to fair wear and tear.
6.2 Any Damage to the Vehicle caused by, or attributable to, the Hirer during the Hire Period — including but not limited to bodywork damage, interior damage, glass damage, or mechanical damage caused by misuse — shall be the financial responsibility of the Hirer.
6.3 All repairs for Damage attributable to the Hirer will be carried out by FPK's trusted garage. FPK will provide the Hirer with a written breakdown of repair costs as soon as they are available.
6.4 Where the cost of Damage is significant, FPK may, at its sole discretion, agree to a structured instalment payment plan with the Hirer. Any such arrangement must be agreed in writing prior to repair works commencing. Standard payment terms apply unless otherwise agreed.
6.5 FPK reserves the right to retain the security deposit and/or withhold the Vehicle pending settlement of outstanding damage costs.
7. Accidents & Incidents
7.1 The Hirer must report any accident, collision or incident involving the Vehicle to FPK as soon as reasonably practicable, and in any event within 24 hours of the incident occurring. A written report and photographs must be provided where possible.
7.2 The Hirer must not admit liability, offer any settlement, or make any statement to a third party in connection with an accident without the prior consent of FPK.
Non-Fault Accidents
7.3 Where the accident is deemed to be the fault of a third party:
- The Hirer must contact their own H&R insurance provider to notify them of the incident and comply with all obligations under their policy;
- FPK Car Hire Ltd will contact its own insurer and/or pursue a claim against the at-fault third party or their insurer;
- Any financial settlement, compensation or payment received by FPK in connection with the incident — including any vehicle repair or replacement payment — shall belong to and be retained by FPK Car Hire Ltd;
- The Hirer must cooperate fully with FPK and any relevant insurers throughout the claims process, including providing statements, photographic evidence and any other information reasonably required.
At-Fault Accidents
7.4 Where the Hirer is wholly or partially at fault for an accident:
- The Hirer shall be fully responsible for the cost of repairing any Damage to the Vehicle;
- Repair costs may, at FPK's sole discretion, be paid by the Hirer in agreed instalments as set out in clause 6.4;
- All repairs will be carried out by FPK's trusted garage. FPK will seek the most cost-effective solution reasonably available;
- The Hirer remains liable for any third-party property damage, injury claims or associated costs arising from the at-fault accident.
7.5 FPK reserves the right to recover the Vehicle immediately following a serious accident, or where the Hirer is no longer legally permitted to drive.
8. Permitted Use of the Vehicle
8.1 The Vehicle is licensed for private hire use and may be used on TfL-approved private hire platforms including Uber, Bolt, Ola, FreeNow and Addison Lee, subject to the Vehicle's PHV plate status and any platform-specific requirements.
8.2 The Hirer must not:
- Use the Vehicle for any purpose other than lawful private hire work;
- Permit any other person to drive the Vehicle without the prior written consent of FPK;
- Take the Vehicle outside of the United Kingdom without FPK's prior written consent;
- Use the Vehicle in any race, rally, speed test or contest;
- Carry hazardous, illegal or prohibited goods or substances;
- Overload the Vehicle beyond its manufacturer's stated passenger capacity;
- Smoke, vape or permit others to smoke or vape inside the Vehicle;
- Allow animals inside the Vehicle (except registered assistance animals) without FPK's prior consent;
- Use the Vehicle in a manner likely to cause damage, excessive wear or bring FPK into disrepute.
8.3 The Vehicle must only be driven by the named Hirer on the hire agreement, unless otherwise expressly agreed in writing by FPK.
9. Fines, Penalties & Charges
9.1 The Hirer is solely responsible for all fines, penalties, charges and surcharges incurred during the Hire Period, including but not limited to:
- Speeding fines and fixed penalty notices;
- Congestion Charge and Ultra Low Emission Zone (ULEZ) charges;
- Penalty Charge Notices (PCNs) for parking contraventions, bus lane violations or moving traffic offences;
- Red light camera penalties;
- Toll road or bridge charges;
- Any other motoring fines, penalties or enforcement charges.
9.2 Where FPK receives notification of a fine or charge attributable to the Hirer, FPK reserves the right to pay the fine on the Hirer's behalf and recover the full amount from the Hirer, together with a reasonable administration fee to cover FPK's time in handling the matter.
9.3 Persistent or significant outstanding fines may result in deduction from the security deposit or termination of the hire agreement.
9.4 The Hirer is responsible for notifying FPK of any fines, summons or penalty notices received during the Hire Period. Failure to disclose such notices may result in additional liability for the Hirer.
10. Return of the Vehicle
10.1 The minimum hire period is one (1) calendar month. The Hirer may not return the Vehicle before the expiry of the initial month. After the initial month, either party may terminate the hire agreement by providing a minimum of seven (7) days written notice to the other party, unless otherwise agreed in writing at the commencement of hire.
10.2 Upon receipt of notice to terminate, FPK will confirm the return arrangements and provide the Hirer with the address to which the Vehicle must be returned. The return address will be confirmed by FPK and may differ from the original collection point.
10.3 The Vehicle must be returned:
- To the address confirmed by FPK, at the agreed date and time;
- In a clean condition, both inside and outside;
- With a reasonable level of fuel in the tank;
- With all keys, accessories, documentation and items provided at the commencement of hire.
10.4 FPK will inspect the Vehicle upon return. Any Damage beyond fair wear and tear will be assessed, documented and charged to the Hirer in accordance with clause 6.
10.5 The security deposit will be returned to the Hirer within a reasonable period following the satisfactory return of the Vehicle and full settlement of all outstanding amounts owed to FPK.
10.6 FPK reserves the right to terminate the hire agreement immediately and without notice if the Hirer:
- Fails to maintain a valid TfL PHV driver licence or valid H&R insurance;
- Is convicted of a serious driving or criminal offence;
- Fails to pay the Hire Fee when due;
- Breaches any material provision of these Terms and Conditions;
- Uses the Vehicle in an unlawful or reckless manner;
- Provides false or misleading information to FPK.
11. Data Protection & Privacy
11.1 FPK Car Hire Ltd is the data controller for all personal data collected in connection with the hire of vehicles. We are committed to protecting the privacy and personal data of our hirers in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
What We Collect
11.2 In order to process your hire application and manage the hire agreement, FPK collects and retains copies of the following personal data:
- Full name, date of birth and contact details (phone number and email address);
- A copy of your DVLA driving licence (front and back);
- A copy of your TfL Private Hire Vehicle (PHV) driver licence;
- Proof of address (e.g. utility bill or bank statement);
- Details of your hire-and-reward insurance policy;
- Payment information and records;
- Records of any accidents, incidents or Damage occurring during the Hire Period.
Why We Collect It
11.3 Your personal data is collected and processed for the following lawful purposes:
- To verify your identity and confirm your eligibility to hire a vehicle;
- To enter into and administer the hire agreement;
- To process payments and recover any outstanding amounts owed;
- To manage insurance claims, accident notifications and legal matters;
- To comply with legal, regulatory and licensing obligations;
- To pursue or defend legal claims where necessary.
How Long We Keep It
11.4 We will retain your personal data for a minimum period of six (6) years following the end of your hire agreement, in line with our legal and contractual obligations.
Who We Share It With
11.5 Your personal data will not be sold or shared with third parties for marketing purposes. It may be shared only where:
- Required to manage the hire agreement (e.g. our trusted garage for repair work, or insurance providers in relation to claims);
- Required by law, court order or a regulatory authority;
- Necessary to pursue or defend legal proceedings.
Your Rights
11.6 Under UK GDPR, you have the following rights regarding your personal data:
- Right of access — to request a copy of the personal data we hold about you;
- Right to rectification — to request correction of inaccurate or incomplete data;
- Right to erasure — to request deletion of your data, subject to our legal obligations;
- Right to restrict processing — to request that we limit how we use your data;
- Right to data portability — to receive your data in a portable format;
- Right to object — to object to processing based on legitimate interests.

11.8 If you remain dissatisfied with our response, you have the right to lodge a complaint with the Information Commissioner's Office (ICO) at www.ico.org.uk.
12. Limitation of Liability
12.1 FPK's total liability to the Hirer under or in connection with these Terms shall not exceed the total amount of Hire Fees paid by the Hirer in the four (4) weeks immediately preceding the event giving rise to the claim.
12.2 FPK shall not be liable for:
- Loss of earnings, income or profits by the Hirer during any period the Vehicle is unavailable (including during servicing or following an accident);
- Any indirect, consequential, special or punitive loss;
- Loss of or damage to personal property left in the Vehicle;
- Any loss arising from the Hirer's failure to maintain valid insurance, licences or permits.
12.3 Nothing in these Terms shall limit or exclude FPK's liability for death or personal injury caused by FPK's negligence, for fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
13. General Provisions
13.1 Entire Agreement. These Terms and Conditions, together with the signed hire agreement, constitute the entire agreement between FPK and the Hirer in respect of the hire of the Vehicle and supersede all prior representations, agreements and understandings.
13.2 Amendments. FPK reserves the right to amend these Terms and Conditions at any time. Any material amendments will be communicated to the Hirer in writing with reasonable notice before taking effect.
13.3 Severability. If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13.4 Waiver. A failure or delay by FPK to exercise any right or remedy under these Terms shall not constitute a waiver of that right or remedy.
13.5 Governing Law. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
